Ontario's Occupiers' Liability Act | What It Means for Your Claim

Property owners in Ontario have a legal duty to keep their premises safe. The Occupiers’ Liability Act, R.S.O. 1990, c. O.2 sets that standard. Under this Act, every occupier whether a business, landlord, or municipality,  must take reasonable steps to prevent foreseeable harm. When they fail, you have the right to sue.

Who qualifies as an “occupier”? Anyone with physical possession or responsibility for a premises. This includes store owners, property managers, condo corporations, and contractors with temporary site control. The Act does not require proof of intent. Negligence is enough. If a hazard existed long enough that a reasonable person would have addressed it, the occupier is liable.

In Mississauga and the broader Peel Region, slip and fall claims are processed through the Ontario Superior Court of Justice, located at 7755 Hurontario Street.

There is no upfront cost to pursue a claim under the Occupiers’ Liability Act with Maana Law. We work on full contingency.

Ensuring Property Safety in winter

Slipped on Ice in Mississauga? Property Owners Are Still Responsible

Ice and snow are not excuses. Ontario law still requires property owners to maintain safe conditions during winter.

Mississauga receives an average of 115 cm of snowfall per year. Between November and March, icy walkways, unsalted stairs, and unplowed lots are the leading cause of slip and fall injuries in Peel Region.

Over 60% of winter slip and fall claims in Ontario involve a failure to salt, sand, or clear ice within a reasonable timeframe, according to Ontario Trial Lawyers Association data.

What counts as a “reasonable” response time?

  • Private commercial properties: typically 2 to 4 hours after snowfall ends
  • Residential landlords: depends on lease terms and municipal by-laws
  • City of Mississauga: salting and sanding must occur within Region of Peel maintenance guidelines

How to Strengthen a Winter Slip and Fall Claim

  • Photograph the scene immediately, showing ice depth and no visible salt or sand
  • Note the weather conditions and exact time of the fall
  • Identify nearby cameras including parking lot CCTV and doorbell cameras
  • Get the names of any witnesses present
  • Preserve the footwear you were wearing that day

Courts evaluate whether the property owner knew or should have known about the ice hazard. Recurrence on the same spot is strong evidence of ongoing negligence.

Where Slip and Fall Accidents Happen Most in Mississauga

Location determines who is liable. Mississauga’s busy commercial zones, transit hubs, and winter-prone sidewalks create specific risk environments.

Retail Stores and Shopping Malls

Square One Shopping Centre, Heartland Town Centre, and local grocery chains are frequent sites. Liability falls on the store operator when spills go unmarked or floors are mopped without warning signage.

Parking Lots and Garages

Ice accumulation and uneven asphalt in lots along Hurontario Street and around Mississauga City Centre are common hazards. Property managers owe a duty to salt and maintain these areas year-round.

Apartment Buildings and Condos

Lobbies, stairwells, and underground garages in high-rise buildings near Port Credit and Erin Mills are repeat-offender locations. Condo corporations can be named as defendants in your claim.

Public Transit Stations

MiWay bus stops and GO Transit platforms in Mississauga carry municipal or Metrolinx liability. Special notice rules apply if your fall occurred at a transit site. See Section 4 below.

Medical Facilities and Offices

Trillium Health Partners and other Peel Region medical centres face the same occupier duty as commercial properties. Slippery tile floors and missing handrails are common failure points.

Construction Sites

Temporary walkways, exposed debris, and poor signage in rapidly developing Mississauga neighbourhoods like Cooksville and Lakeview increase risk for pedestrians and nearby residents.

Common Injuries After a Slip and Fall in Mississauga

Slip and fall accidents can cause serious, sometimes life-changing injuries. The severity often depends on the surface, the height of the fall, and the person’s age.

These are the most common injuries our Mississauga slip and fall lawyers see after a fall.

  • Hip fractures
Often caused by icy parking lots or wet tile floors. Recovery is commonly 3 to 6 months, and surgery is often required.

  • Traumatic brain injury (TBI)
Often happens when the head hits the ground or a hard surface. Recovery can range from a few weeks to permanent impairment, depending on the severity.

  • Spinal cord injuries
Common after falling down stairs or sudden drops in a parking lot. Recovery can take months to years, and in some cases the injury can be permanent.

  • Wrist or arm fractures
Frequently caused by bracing during the fall. Many cases recover in 6 to 8 weeks, depending on the fracture and treatment.

  • Knee ligament tears (ACL or MCL)
Often caused by a twisting fall on uneven surfaces. Recovery is commonly 6 to 12 months after surgery.

  • Soft tissue injuries and chronic pain
Can happen after any fall, especially when symptoms show up later. Recovery can be ongoing and may require continued therapy.

Injuries to seniors are often especially severe. Public Health Agency of Canada data shows falls cause a very large share of injury-related hospitalizations among adults 65 and older.

Important: Even if you feel fine right after the fall, some injuries, including internal bleeding or spinal compression, can appear hours or days later. See a doctor the same day.

Slipped on City Property? Ontario's 10-Day Notice Rule Could Cost You Everything

This is the most overlooked rule in slip and fall law. Missing it eliminates your claim entirely.

If your accident happened on a sidewalk, road, park, or any property maintained by the City of Mississauga, Peel Region, or a provincial body, you must serve written notice within 10 days of the accident.

This requirement is governed by the Municipal Act, 2001, S.O. 2001, c. 25, s. 44(10). Courts have very limited discretion to waive it.

What happens if you miss the 10-day deadline? You may be permanently barred from filing a claim, even if the city was 100% at fault.

What must the notice include? Your name, the date of the accident, the exact location, and the nature of your claim.

Common municipal slip and fall sites in Mississauga include sidewalks on Hurontario, Dundas, and Burnhamthorpe, as well as city-owned transit stops and parks along Lake Ontario.

If your fall happened on city or regional property, even if you are unsure, contact a slip and fall lawyer in Mississauga within 48 hours. Every day counts.

Legal deadlines after an accident
Deadline for the property

How Long Do You Have to File a Slip and Fall Claim in Mississauga?

The standard limitation period in Ontario is 2 years from the date of the accident, under the Limitations Act, 2002, S.O. 2002, c. 24, Sched. B.

But deadlines are not always that simple. Several exceptions apply.

Standard 2-Year Limit Most slip and fall claims against private property owners, businesses, and individuals must be filed within 2 years of the accident date.

Municipal Property – 10-Day Notice Rule Falls on city sidewalks, roads, or parks require written notice to the municipality within 10 days. Missing this can void your claim regardless of the 2-year window.

Minors Under 18 The 2-year clock does not start until the minor turns 18. Contacting a lawyer early still preserves crucial evidence and strengthens the case.

The Discovery Rule If your injury was not discovered immediately, for example a spinal compression injury diagnosed weeks after the fall, the 2 years may begin from the date of discovery, not the fall itself.

Psychological Injury If a condition such as PTSD or clinical anxiety developed after the fall and was not diagnosed promptly, a different discovery date may apply to your limitation period.

Deceased Claimants Family members may have 2 years from the date of death to file under the Family Law Act, in cases where a fall ultimately led to a fatality.

Limitation periods in Ontario are strictly enforced. Courts rarely grant extensions. If you are unsure of your deadline, call us today before time runs out.
